Thomas More Society backs pregnancy help organizations in lawsuit to protect Abortion Pill Reversal
ROCHESTER, N.Y. — Heartbeat International, CompassCare, and a collective of pregnancy help organizations — represented by Thomas More Society — are suing to block imminent, ruinous legal action threatened by New York Attorney General Letitia James against pro-life ministries that offer and/or promote Abortion Pill Reversal (APR). On April 30, Thomas More Society attorneys filed a verified complaint in the Supreme Court of New York against James, outlining how her threatened prosecution and intimidation of pregnancy help organizations violates the First and Fourteenth Amendments of the United States Constitution, the New York Constitution and state civil rights law.
On April 22, James’ office sent “Notice of Intention to Sue” threat letters to at least a dozen pregnancy help organizations that offer or share information about the APR protocol. James’ threat letter falsely accuses the targeted pregnancy help organizations of “repeated and persistent misleading statements and omissions.” In their filing today, Thomas More Society clearly lays out why the organizations’ communications about APR are truthful and, even more, fully protected under the First Amendment. The threat letters gave these pro-life ministries only five business days to explain why James should not sue them for false advertising — their lawsuit is the response to those notices.
Thomas More Society attorneys are requesting court intervention against the Attorney General’s threatened legal action, to safeguard the constitutional rights of Heartbeat International and the collective of pregnancy help organizations — many of which are part of Heartbeat International’s Abortion Pill Rescue® Network, or otherwise provide information about APR. At its core, James’ threatened litigation seeks to illegally silence Heartbeat International and its network member organizations from sharing their science-based, life-affirming message about the benefits, success, effectiveness and safety of APR.
Peter Breen, Thomas More Society Executive Vice President & Head of Litigation, said:
“This is a political witch-hunt against small nonprofits that have selflessly served New York’s pregnant women and their children for over 50 years. Letitia James should be heralding these charities, not launching outrageously false claims against them under laws that don’t apply to their noncommercial speech. For decades, doctors have been prescribing supplemental progesterone for pregnant women at serious risk for miscarriage—but because this safe and long-established practice may actually reverse abortions, ideologues like Letitia James now want to squelch it. Ms. James’ Notices of Intention to Sue are a transparent attempt to harass small pro-life charities into silence, targeting her political opponents because of their beliefs, in flagrant violation of the First Amendment. We will fight back as long as it takes against Ms. James’ efforts to jeopardize the Christian and life-affirming missions of Heartbeat International, CompassCare, and all similar pro-life ministries in the State of New York.”
Jor-El Godsey, President of Heartbeat International, stated:
“New York State laws protect abortionists and abortion on demand up until birth. Now they are targeting those who assist a woman in exercising her right to continue her own pregnancy. It is unconscionable to see the abortion industry and its paid-for politicians go so far as to insist she complete an abortion she no longer wants.”

“The actions of the New York Attorney General should be a major red flag for all Americans, wherever they stand in the abortion debate. Conspiring to violate the constitutional rights of the politically disfavored sets an ominous precedent and, if allowed to stand, will only serve to dismantle American rule of law.”

“If we truly believe that women should have a choice in her pregnancy decision, then she should also have the choice to reconsider her abortion after taking the first chemical abortion pill. The NY Attorney General is falsely accusing our centers of sharing misinformation with our clients about this life-saving protocol. It is simply not true. Abortion Pill Reversal gives women a second chance to choose life.”

Heartbeat International, in conjunction with a collective of pregnancy help organizations, has taken legal action against the Office of New York Attorney General Letitia James for egregious violations of fundamental rights, including freedom of speech, free exercise of religion, equal protection under the law, and civil rights violations. The lawsuit, with legal representation provided by the Thomas More Society, comes in response to the unjust targeting of not-for-profit life-affirming pregnancy help organizations by the Attorney General's office, which has sought to silence their life-saving message and deny women access to crucial information and support during unplanned pregnancies.
The lawsuit challenges the discriminatory practices of the Attorney General's office, which have unfairly singled out pregnancy help organizations solely because they offer alternatives to abortion. These organizations, represented pro bono by the Thomas More Society, play a vital role in providing support and information to women facing unplanned pregnancies, ensuring they have access to all available options and empowering them to make informed choices about their futures. Our lawsuit challenges the Attorney General's office's pattern of discrimination against pregnancy help organizations and seeks to uphold the rights of women to receive comprehensive information and support during unplanned pregnancies.

Even in the midst of the attack, our focus remains: women, like Cassidy, deserve the right to try to save their pregnancies. No woman should ever be forced to complete an abortion she no longer wants. While we wish every affiliated individual could join us at the Conference, some of our friends and affiliates from outside the United States are not able to join us this year. As is our tradition, we celebrate with a Parade of Nations at the Heartbeat International Annual Conference. Every country with a Heartbeat affiliate will be represented at this parade, and we need your help to carry a flag and represent a country.
On September 21, 2023, Heartbeat International learned through interview requests that the California Attorney General is suing to block us from “advertising Abortion Pill Reversal as safe and effective.” Through our Abortion Pill Rescue Network hotline, we know that some women almost immediately regret their chemical abortion choice. These women deserve the right to try and save their pregnancies.
Attorney General Bonta’s lawsuit against Heartbeat International aims to conceal life-saving information from women regarding Abortion Pill Reversal, despite overwhelming evidence of its safety and effectiveness.

To put it plainly: The lawsuit’s claims are flawed. We look forward to correcting the record and continuing to help women desperately seeking a last chance to choose life.
TRIAL TIMELINE BY DAY
Below is a day-by-day breakdown of the trial highlights, starting with the most recent testimony.
Attorneys on both sides will soon submit their trial briefs, due August 27, and make their closing arguments on September 17. California requires state judges to issue a ruling within 90 days after the case is officially submitted for decision.
Tasha Keirns (BSN, RN), CEO of RealOptions, testifies about the care her organization offers to California women who seek it.
Christa Brown (BSN, RN, LAS), Senior Director of Medical Impact at Heartbeat International, who oversees the Abortion Pill Rescue® Network, continues her testimony.
Both Christa and Tasha serve women who are looking for a second chance at choice. California argues that the intent of its lawsuit is to protect women’s health; however, the attorney general is denying women information they seek out and have a right to receive. Heartbeat’s attorneys at legal non-profit Thomas More Society address this argument in more detail on their website.

California mom, Elizabeth Barrett testifies about her experience with APR. When asked why she volunteered to testify, Elizabeth says, "What I lived through is controversial... I only know that because anytime I bring it up, people having feelings [about it]..." She “just want[ed] to share what it was like."
Elizabeth’s healthy baby girl was born in 2024. Today, Elizabeth and her partner, Ben, are married. Her story is full of redemption and hope; her story–and pictures of her baby girl–are also part of the legal record.

David Glidden, Ph.D statistics expert for the State, returns to testify.
Valerie Hill, CEO Emeritus at RealOptions, testifies. In her legal declaration, submitted when she served as CEO, Valerie notes that “[a]ll women who consider or choose abortion are dealing with varied and difficult circumstances that led them to make an abortion decision.” Also, her declaration notes, “RealOptions makes absolutely no money from providing APR services.”
Donna Hecke, Chief Marketing Officer at RealOptions, testifies. California is seeking to make the case that Heartbeat and RealOptions’ speech is “commercial speech” and subject to state consumer fraud law. The problem for California is that a free service by nonprofits simply is not “commerce.” Heartbeat’s attorneys at Thomas More Society address this and other false claims on their APR website.
Dr. George Delgado continues to testify. In his closing comments, Dr. Delgado shares his motivation for creating and practicing the APR protocol: “...I see no higher calling than to help these women who are asking for a second chance at choice…. I know that I'm doing the right thing for these women, and for their children who are to be born later.”
California APR mom Uyen Pham testifies about how her boyfriend kept arguing that someone her age should not have kids and how he pressured her toward abortion. At about nine weeks pregnant, she took the first abortion pill, mifepristone, and almost instantly regretted the decision. Even though a Planned Parenthood employee told her that, once she started, she couldn’t stop the procedure, Uyen decided she wanted her baby.
Because of Heartbeat and RealOptions, Uyen continued her pregnancy without any side effects or complications from taking the progesterone–and welcomed a healthy baby boy. In testimony and written declaration, Uyen expresses gratitude for the opportunity to save her child’s life. Pictures of Uyen’s baby boy are submitted as part of the legal record.
Dr. George Delgado, an M.D., testifies. Dr. Delgado is a pioneer of the APR protocol and groundbreaking APR research. In 2012, he established the original Abortion Pill Reversal Network, before transferring it to Heartbeat International in 2018, when it became the Abortion Pill Rescue® Network. As part of the legal record, a California mom submitted testimony about how Dr. Delgado provided progesterone treatment to her about 15 years ago–enabling her to continue her pregnancy and deliver a baby boy who is now 14 years old.

Professor Laura Munoz, Ph.D., Professor of Marketing at the University of Dallas, testifies that Heartbeat’s and RealOption’s communications about APR are not misleading under standard advertising and marketing principles. Christa Brown (BSN, RN, LAS), who oversees the Abortion Pill Rescue® Network for Heartbeat International, testifies. Christa describes how APRN nurses inform callers about their options and explain the APR protocol and then refer the patient to local medical providers who supervise their care.
Michael J. New, Ph.D., assistant professor of practice at the Busch School of Business at the Catholic University of America, testifies about the scope and validity of the medical studies and their methods surrounding APR.
Elena Kraus M.D., Ph.D. wraps up testimony.
Elena Kraus M.D., Ph.D., medical expert for the defense, testifies. She specializes in maternal-fetal medicine, regularly provides assessment and counseling concerning the safety of a wide variety of medications used to treat medical diagnoses in pregnancy, and conducts original research and has authored or co-authored peer-reviewed and other publications in multiple areas of medicine and health care ethics. Dr. Kraus noted in her written declaration: “Based on my review of the scientific literature, I conclude to a reasonable degree of scientific certainty that providing pregnant women with supplemental progesterone following the initiation of a medication abortion is safe and efficacious at increasing the likelihood of continuation of pregnancy.”

Erika Carillo, a mother who was able to save her baby after starting APR, testifies. At RealOptions, she had an ultrasound and was able to see her unborn baby for the first time. Erika’s son is nine years old this year. Her story–and pictures of her son–are now part of the public legal record.
Mary Davenport, M.D. and OB/GYN and Medical Director for RealOptions, begins her testimony. She explains how RealOptions offers the APR protocol to women who have taken the first abortion pill but have regrets and want to try to continue their pregnancies.
Heartbeat International President Jor-El Godsey finishes his testimony. Jor-El testifies that, “Every day we answer the phone for women who are regretting their decision of taking that first pill of the chemical abortion, looking for an answer… We know our information is good. We know that lives have been saved.”
Professor Briony Swire-Thompson, Ph.D., California’s “misinformation” expert, testifies. The State claims APR is “false advertising,” yet scientific evidence supports APR claims. Thomas More attorneys explain more here.
Heartbeat International President Jor-El Godsey takes the stand to give testimony and explains that Heartbeat receives no kickback or payment but simply answers the call from women who call our hotline in tears, know they’ve made a mistake, and want a chance to continue their pregnancies and meet their babies.

Heartbeat International clarifies what’s at stake in the lawsuit and asks supporters for prayer.
Danielle White, General Counsel for Heartbeat International, writes how “[p]oliticians who routinely invoke the language of ‘choice’ now seek to suppress information that women are seeking.”
Attorneys for the State of California and Heartbeat International and RealOptions make their opening arguments. Dr. Mitchel Creinin, the State’s medical expert, also begins testimony.
In his opening argument, Paul M. Jonna, Special Counsel for Thomas More Society and Partner at LiMandri & Jonna LLP, states, “This case asks whether the State can punish truthful information about a free service as commercial fraud. By the end of this trial, the evidence will show that it cannot—for reason after independent reason.” Thomas More publishes the opening statement on its website.

The State of California has conceded that it has received no complaints from California women regarding APR.

Thomas More Society Attorneys Ask Court to Throw Out AG Rob Bonta’s Lawsuit
(February 6, 2024 – Oakland, California) Today, Thomas More Society attorneys asked a California Superior Court to throw out the lawsuit filed by California Attorney General Rob Bonta against Heartbeat International and RealOptions Obria Medical Clinics, over their advocacy for “Abortion Pill Reversal,” the medical intervention provided to women who decide to reverse their in-progress chemical abortions. The hundreds of pages of argument and evidence represent the most comprehensive legal counterattack by the pro-life movement against recent legal maneuvers by state government officials like Bonta who are trying to interfere with and stop the efforts of pregnancy centers to help women who regret and want to reverse their chemical abortions.
Heartbeat International, an international network of thousands of pregnancy centers, provides referrals to medical providers for women who are seeking to reverse their chemical abortions through its Abortion Pill Rescue® Network, which is the target of Bonta’s lawsuit, along with the RealOptions pregnancy centers in California, which provide Abortion Pill Reversal services. Abortion Pill Reversal is the process of providing supplemental progesterone to counteract the anti-progesterone effects of the first pill (mifepristone) of the two-pill chemical abortion regimen.
“Women undergoing chemical abortions deserve the truth: even after starting a chemical abortion, they may still be able to save their babies,” remarked attorney Peter Breen, Thomas More Society Executive Vice President & Head of Litigation. “California and its Attorney General Rob Bonta are illegally and unconstitutionally seeking to rip away ‘choice’ from women in dire need by attacking pregnancy help ministries like Heartbeat and RealOptions, to shut down their promotion of Abortion Pill Reversal. Abortion Pill Reversal provides real hope for women who want to stop their abortions and continue their pregnancies. Today’s massive legal filings mark the most ambitious and broad-based counterattack by the pro-life movement against the efforts of state officials, like Rob Bonta, who intend to prevent women from accessing this potentially life-saving treatment option.”
Heartbeat International President Jor-El Godsey agrees:
“California should be more concerned with helping women who desperately want to continue their pregnancy,” stated Godsey. “Targeting women’s opportunity to reverse their abortion is an obvious act of misusing the goodwill of taxpayer funding to shill for Big Abortion.”
Bonta’s aggressive campaign to dismantle Heartbeat International’s Abortion Pill Rescue Network and shut down RealOptions’ Abortion Pill Reversal services went public when he filed a Complaint for Permanent Injunction against both, along with 100 unnamed “Does,” on September 21, 2023, in the Alameda County Superior Court of California.
“Despite overwhelming evidence of Abortion Pill Reversal services’ safety and effectiveness, this lawsuit makes outrageously false claims against Heartbeat International and RealOptions,” explained Paul Jonna, Thomas More Society Special Counsel and Partner, LiMandri and Jonna LLP. “Attorney General Bonta’s lawsuit aims to hide life-saving information from women regarding Abortion Pill Reversal. This is a desperate attempt by Bonta to eliminate any competition to the well-funded abortion lobby with which he has proudly partnered throughout his political career.”
In their February 6, 2024, filings, Thomas More Society attorneys advance three main arguments:
(1) The First Amendment protects the advocacy efforts and information provided by Heartbeat and RealOptions to women about Abortion Pill Reversal.
(2) On Bonta’s claims, the Superior Court cannot decide a “battle of scientific experts” between Heartbeat’s scientific studies and Bonta’s competing studies on Abortion Pill Reversal.
(3) California’s Reproductive Privacy Act and its Constitution totally immunize Heartbeat and RealOptions, prohibiting Bonta from interfering with their aid and assistance to pregnant women who want to stop and reverse their chemical abortions.
Among the information provided to the Superior Court, Thomas More Society provided compelling evidence of the safety of supplemental progesterone for pregnant women and its effectiveness in countering the effects of mifepristone, the first pill of the two-pill chemical abortion regimen. In particular, progesterone has been safely used by obstetrician-gynecologists for decades to thwart potential miscarriage in pregnant women.
